Welcome to Human Creative, LLC ("Company"), the provider of Human Creative, LLC’s Certified Human Content(™) ("Platform"). Please read these terms carefully. By accessing or using our human content authentication and certification platform, Certified Human Content(™), and/or its applications and/or its web-extension, you agree to abide by these Terms of Service. If you do not accept all of the terms and conditions contained in or incorporated by reference into this Agreement, please do not use the Platform. Human Creative, LLC only grants use of and access to this Website, and its services to those who accept these terms.
1. Description of Service
Human Creative, LLC provides a human content authentication and certification service designed to certify user content as being authentically produced by the user. The certification service offers levels of security to prevent generative AI inclusion and to promote original human content. The Certified Human Content(™) philosophy is:
Prevent: The platform prevents the use of generative-AI by requiring content to be produced within the platform and by blocking common generative-AI sources. Additionally, the platform offers the linking of other devices with a “phone-lock” feature which offers additional assurance that a user was not cheating by utilizing another device.
Deter: The platform deters the use of generative AI by auditing pasted content and actively scanning written content for common generative-AI words, phrases, and structure. Unverifiable sources of pasted content and generative AI text will be uncertifiable.
Monitor: Human auditors (an additional, optional service) review the entire creative process for signs of human originality with our proprietary editorial-behavioral analysis. The human auditing feature is the Gold Standard for proving a work was made without generative AI.
Promote: The platform promotes human originality by making the use of generative-AI a personal hassle. It is difficult to utilize the platform while bouncing around on multiple devices, browsers, and especially while trying to sneak-in generative-AI. The platform promotes human originality by refusing to certify trope generative-AI phraseology, and by prohibiting or making difficult behaviors which might allow AI to be secretly snuck-in. The platform makes using your own creativity the path of least resistance.
Disclose: Certified Files will disclose many details about their crafting process to a verifier, including (but not limited to, depending upon plan type, and release date), how long a file took to craft, how many times the writer exited and re-entered the editor, whether their device was locked during the entire crafting process, whether their tabs were actively monitored for AI tabs, whether they pasted content and how frequently, which components of their file were pasted, whether the document passed a human audit, and more. While no platform is fool-proof against AI, we believe that transparency about how a document was crafted provides an extra layer of accountability for those utilizing the platform and assurance for those verifying files. Users understand that details about their file, and their files’ contents (if certified publicly), can be revealed to verifiers.
Quality Standards: Certified Human Content™ provides the highest assurance available to verifiers that certified files were crafted without the use of generative AI. While Human Creative, LLC cannot guarantee that any specific file was completely free of generative AI, the platform of preventing, monitoring, deterring, promoting, and disclosing (explained above) is the best way to ensure a file was created without generative AI.
2. User Responsibilities
Do not use Artificial Intelligence (LLM) tools.
Do not plagiarize.
Do not input PII, confidential and proprietary, or other information that should not be seen by human auditors at the Company.
Do not attempt to reverse-engineer, exploit, or manipulate the Platform.
User Assumes Full Responsibility By downloading, installing, accessing, or using this software ("Software"), the user ("You") acknowledges and agrees that You are solely and entirely responsible for any and all outcomes, consequences, damages, losses, or liabilities that may arise from such use. This includes, but is not limited to, data loss, platform failure, business interruption, legal claims, or financial harm.
I. No Warranties Provided. The Software is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied. The Company makes no representations or guarantees regarding the accuracy, reliability, security, performance, or fitness for a particular purpose of the Software.
3. User Requirements
You must be at least 13 (thirteen) years of age to use the Platform. By using the Platform, you warrant that you are at least 13 years of age. Human Creative, LLC assumes no responsibility for liabilities for any misrepresentation you make when accessing and using the Platform. Human Creative, LLC may, in its sole and absolute discretion, refuse to allow use of the Platform or accept a person’s or entity’s information and may, at any time, refuse to permit a person’s, or entity’s, continuing use of the Website for any reason or for no reason, in its sole discretion.
4. Limitations and Liability
The Platform certifies content based on the data stream, review by Company auditors, and various algorithms, but it cannot completely guarantee that users have not bypassed controls using physical or other technological means. The Company shall not be liable for any damage or injury to the User, or any other person as a result of the use of the Platform. The User agrees to hold the Company harmless from any such claims.
5. No Liability of the Company
Under no circumstances shall the Company, its affiliates, directors, officers, employees, agents, or licensors be liable to You or any third party for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with the use of the Software, even if advised of the possibility of such damages.
6. Indemnification
You agree to indemnify, defend, and hold harmless the Company from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from Your use of the Software or violation of this policy.
Your full and complete interactions with the editor are logged and processed as human provenance data in accordance with our Privacy Policy. Your use of the web-extension, and phone application, will integrate data through the web-editor which will also be stored. We take data security seriously and implement measures to protect your personal information.
8. Intellectual Property
All technology associated with Human Creative, LLC is the property of Human Creative, LLC or its licensors. Unauthorized reproduction, distribution, or modification of the Platform functionalities is strictly prohibited.
We make no claims to any user IP that may be stored in the Platform. Users retain all rights and ownership of their IP.
To that end, human auditors are required to sign a non-disclosure agreement concerning audited content. Auditors are not allowed to disclose any information related to user file contents to anyone outside of the Human Auditor Network; whereas they are not allowed to disclose details of a user's file content to other employees at Company; whereas they may not copy, share, disseminate, or replicate any of written content contained within a user’s file, at any time, or for any purpose, to others inside of the Company auditor network, to other employees at Company, or to anyone outside of the company; Auditors commit to observing these policies, of not disclosing.
The intellectual property of user files is retained by the user and is protected. Neither Company nor Auditor may appropriate intellectual property from a user file.
Auditors may reference file contents to Superiors in the Human Auditor Network only for the scope of addressing disputed files (a disputed file is a file which a human auditor has rejected for human auditor approval, but has been appealed by the user to a Superior for review). In the case of a disputed file, file contents may be referenced solely for the purposes of evaluating the human originality or generated qualities of the content.
9. Service Modifications
Human Creative, LLC reserves the right to modify, suspend, or discontinue the Platform, or a user’s membership subscription within the platform for violation of agreement, at any time without prior notice.Changes to these Terms may also be made, and continued use of the Platform after such modifications constitutes acceptance of the updated Terms.
10. Dispute Resolution & Governing Law
These Terms shall be governed by the laws of the State of West Virginia. Any disputes arising from Platform use shall be resolved through arbitration or in the courts of the State of West Virginia.
11. Compliance and Risk Management
You are solely responsible for ensuring that your use of the Platform complies with all applicable laws, regulations, and industry standards. You acknowledge that the Platform may not be suitable for use in high-risk environments or applications where failure could result in significant harm.
12. Copyright and Trademark Notices
Nothing in these Terms of Service or on the Platform shall be construed as granting, by implication, or otherwise, any license or right to use any trademarks, trade names, logos, images, typefaces, graphics, service marks and trade dress displayed on the Platform (“Mark”) without the prior written consent of Human Creative, LLC or the owner of the Mark. All Marks are owned by Human Creative, LLC.
13. General
You agree that all claims you may have against Human Creative, LLC arising from or relating to the Platform must be heard and resolved in a court of competent subject matter jurisdiction located in the State of West Virginia within two (2) years from the date on which such claim or action arose or accrued or such claim or cause of action will be irrevocably waived. If any part of the Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remaining provisions in the Agreement shall continue in full force and effect.
The Agreement (and any other terms and conditions referenced herein) constitutes the entire agreement between you and Human Creative, LLC with respect to the Platform and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the you and Human Creative, LLC with respect to the Platform. A printed version of the Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to the Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
